The report delivered at the 19th National Congress of the Communist Party of China points out that the principal contradiction facing Chinese society is the contradiction between unbalanced and inadequate development and that between the people’s ever-growing needs for a better life. Moreover, the congress proposes to develop a modernized economy, which has a close inner connection with the principal contradiction facing Chinese society. The evolution of the principal contradiction creates many new demands for the development of economic system in China. Therefore, developing a modernized economy is a requisite and a key step for tackling the social principal contradiction in the new era.

Abstract

:As pointed out in the government report in the 19th CPC National Congress, developing a modernized economy is the key to effectively get through smoothly the economic downturn and thus to achieve a sustainable economic development, against the background of the new and normative development in economic sector. Both the industrial system of coordinated development and the effective economic system not only function as “two wings” of the modernized economy but also work as a focal element to continuously enhance China’s economic creativity and competitiveness. At the request for the development of a modernized economy proposed during the 19th CPC National Congress, this paper further analyzes the connotation, significance, ideas, priorities and tasks of building a coordinated industrial system in order to optimize the economic structure, to explore the new driving force of growth, to improve the utilization of resources and provide the policy reference.

Abstract

:Compared to the physical properties, the protection of the bona fide third party in repetitive sales of copyright is much more complicated. All the factors such as the automatic protection of copyright, the lack of copyright registration, a public notice mechanism, and the complexity of copyright ownership will make the identification of rights holders in copyright transactions to be variable and difficult. Thus, protecting the bona fide third party is theoretically justified and has important practical value. The third revision of the Copyright Law plans to provide legal protection for the bona fide third party by introducing the registration confrontation rules for copyright changes. For the theoretical model of registration confrontation of copyright change, it is appropriate to adopt the “negative right” theory under the theory of third party-claim. Goodwill requires a third party to be without knowledge, no fault, and fulfilling the reasonable duty of care obligation. Prove of goodwill in the change of copyright should be properly distinguished according to the object or content of goodwill, and different standards should be applied. There is room for further discussion on whether the bona fide acquisition rules can be applied to the bona fide third party. An important precondition for the bona fide acquisition is the credibility of the appearance of rights. The credibility of copyright cannot be characterized by possession because its object is intangible property. The generation of credibility of copyright registration depends on the unity, openness and authority of copyright registration, and substantive examination is in need to ensure the registration quality.

Abstract

:The transformation of Criminal Law from traditional to modern is one of inevitabilities of history. In the presence of personal interest, regulating the future behavior by criminal law is also a trend. Since entering the risk society, the connotation and content of legal interest is becoming more abstract, the front protection way of legal interests is expanding, and the base color of legal interest is being covered a kind of “non-human” phenomenon. In the risk society, in order to be aware of the risks of legal interest, prevent legal interest from being weaken and avoid criminal law becoming a tool as criminal policy, protection limit of legal interest should take constitutional principles into consideration, and keep modest and restraint as the limit core. In addition, the ethical baseline of legal interest should stick to the liberalism and humanism. All these aim to maintain the base of legal interest theory.

:As a famous literary landscape of Lingnan in Guangdong province, Luofu Mountain has been written widely since Wei and Jin dynasties in the verses of the literati. The comprehensive descriptions of Luofu Mountain by “Three Lingnan renowned poets” in the early Qing dynasty not only perpetuates a kind of immortally and reclusively spatial imagination that the Mountain has made, but also endow the Mountain local thoughts and homey feeling as a local people. Through their descriptions, Luofu Mountain begins to show itself to the country as an accessible landmark of Lingnan, rather than an unreachable wonderland. Such transformation not only reflects the sense of pride and local identity of the three poets, for they were born in Lingnan but also hopes to introduce its beauty to everyone.

Abstract

:In the past, the academic circles mainly focused on the overseas Chinese in Southeast Asia, North America, Europe and some other areas. However, they did not paid much attention to the migrant history and present conditions of the Chinese immigrants in New Zealand—the land of the long white cloud in South Pacific Ocean. One of the main factors is that, compared with the population of the overseas Chinese in the whole world, the number of the Chinese migrated to New Zea-land in the history was limited. However, New Zealand has become one of the countries with most nationalities in the world nowadays, and ethnic Chinese has become the third biggest ethnic group in New Zealand, only less than ethnic Europeans and Maoris. Base on previous census data in New Zealand history, the new statistics from New Zea-land Immigration Bureau, the official survey reports of New Zealand, and New Zealand’s immigration policies, this article will analyze and summarize the general situation and basic characteristics of the new Chinese immigrants in New Zea-land. It will also, in perspective of transnationalism, on the basis of oral history materials of the new Chinese immigrants in New Zealand, explore the multiple identities of the Chinese community in New Zealand.

Abstract

:Based on self-presentation and other related theories, this paper aims to conduct a qualitative research on the behaviors of youth in Wechat moments. This study shows that the young generation tends to highlight themselves by posting moments in Wechat. Meanwhile, moments play a double role of both front stage and back stage. In this process, there also exist some dramatic characteristics like circle of friends, scheming together and discordant roles. It is not justified that the self-presentation will be closer to reality if there is a strong tie between two sides. Likes and comments strengthen social communication and promote the accumulation of social capital. However, under certain circumstances, there will be variations. The features of psychological development and the social and cultural background can illustrate the logic and meaning hidden behind these behaviors.
