案情回顧：上海警方偵破侵犯“樂(lè)高”玩具品牌著作權(quán)案

2019年4月23日，上海警方在廣東汕頭、深圳等地警方的配合下，成功摧毀了涉嫌侵犯“樂(lè)高”品牌著作權(quán)的犯罪團(tuán)伙——“樂(lè)拼”，抓獲以李某為首的4名犯罪嫌疑人，搗毀生產(chǎn)、包裝、倉(cāng)儲(chǔ)等窩點(diǎn)3處，流水線10余條，繳獲生產(chǎn)模具90余塊，說(shuō)明書(shū)近20萬(wàn)份，包裝盒20萬(wàn)余件，成品“樂(lè)拼”玩具63萬(wàn)余件，涉案金額逾2億元。

“樂(lè)拼”以營(yíng)利為目的，未經(jīng)“樂(lè)高”授權(quán)擅自予以復(fù)制、生產(chǎn)，違法所得數(shù)額巨大，已經(jīng)涉嫌刑事犯罪。目前，該案李某、余某、杜某、閆某等4名犯罪嫌疑人已被依法刑事拘留，案件仍在進(jìn)一步偵辦中。上海警方成功破獲此案，充分彰顯了公安機(jī)關(guān)打擊侵犯知識(shí)產(chǎn)權(quán)犯罪的信心和決心，有力地維護(hù)了企業(yè)的知識(shí)產(chǎn)權(quán)和智力成果。

加強(qiáng)知識(shí)產(chǎn)權(quán)保護(hù) 阻止侵權(quán)

《法人》：今年4月，上海警方偵破侵犯“樂(lè)高”玩具品牌著作權(quán)案，摧毀了山寨品牌“樂(lè)拼”生產(chǎn)和銷(xiāo)售假冒“樂(lè)高”的犯罪鏈條，嚴(yán)厲打擊了“樂(lè)拼”盜版侵權(quán)的違法犯罪行為。關(guān)于這個(gè)案子，您能分享下感受嗎？

Faren Magazine:In April of this year，Shanghai police had spared no efforts to fight against infringing products constantly. In April， they took actions to stop“LEPIN” from counterfeiting and pirating “LEGO”， to stem “LEPIN”in intellectual property theft. Could you please share more details with us regarding this case?

羅燦：知識(shí)產(chǎn)權(quán)是樂(lè)高集團(tuán)業(yè)務(wù)發(fā)展的重要基石，因此，我們不遺余力地在中國(guó)及全球其他地區(qū)加強(qiáng)對(duì)樂(lè)高商標(biāo)、版權(quán)、設(shè)計(jì)及專(zhuān)利的保護(hù)。對(duì)樂(lè)高集團(tuán)而言，確保消費(fèi)者不會(huì)被誤導(dǎo)是非常重要的。消費(fèi)者購(gòu)買(mǎi)的樂(lè)高產(chǎn)品都符合嚴(yán)格的安全和質(zhì)量標(biāo)準(zhǔn)，這是他們可以并且期望從我們的產(chǎn)品中獲得的。

在知識(shí)產(chǎn)權(quán)保護(hù)中，我們的另一個(gè)關(guān)注重點(diǎn)是阻止侵權(quán)者進(jìn)行剽竊。我們歡迎公平競(jìng)爭(zhēng)，但當(dāng)有人濫用我們的IP時(shí)，我們會(huì)堅(jiān)決采取一切必要的法律手段，以保護(hù)消費(fèi)者權(quán)益以及我們的品牌權(quán)益。

舉個(gè)例子，我們已經(jīng)贏得了針對(duì)兩個(gè)侵權(quán)案山寨品牌“Bela”和“樂(lè)拼”的訴訟，法院根據(jù)《中華人民共和國(guó)著作權(quán)法》和《中華人民共和國(guó)反不正當(dāng)競(jìng)爭(zhēng)法》對(duì)案件作出了公正判決。同時(shí)，我們也為上海警方在對(duì)“樂(lè)拼”工廠和倉(cāng)庫(kù)的突擊檢查行動(dòng)提供了有力支持。

Robin Lynne Smith:Intellectual Property rights and assets are fundamental to the LEGO Group business， and we therefore constantly strive to enforce and protect our LEGO trademarks， copyrights，designs and patents， in China as well as abroad. Among others， we always make sure we keep a strong trademark portfolio and prioritize brand protection to ensure that our consumers are not misled. It's critically important to us that when our consumers buy a LEGO? set， they get a product of impeccable quality that lives up to the strictest safety standards， which is exactly what they can and should expect from our products.

Another focus area in our IPR protection is to stop copycat infringers who make blatant copies of LEGO products. We welcome fair competition at any time， but when someone misuses our IP， our brand and the consumer's trust，wetake what everlegal action necessary to protect consumers and our rights in our brand. For example，we have been litigating against two major copycat brands Bela and Lepin and received favorable decisions from Chinese Courts under copyright law and anti-unfair competition law. We also supported the Shang hai police on a massive raid action against the factory and warehouses of Lepin infringers.

對(duì)中國(guó)市場(chǎng)充滿(mǎn)信心

《法人》：10月23日，中國(guó)國(guó)務(wù)院正式公布了《優(yōu)化營(yíng)商環(huán)境條例》，條例明確了為各類(lèi)市場(chǎng)主體投資興業(yè)營(yíng)造穩(wěn)定、公平、透明、可預(yù)期的營(yíng)商環(huán)境的準(zhǔn)則。您對(duì)中國(guó)當(dāng)前的營(yíng)商環(huán)境和市場(chǎng)前景，有哪些看法？

Faren Magazine:On October 23rd， the State Council has made public a regulation for the purpose of further improving the bus iness environment. The regulation specifies the principles for fostering a stable， fair，transparent and predictable business environment. What do you think of the current business environment and market perspective in China?

羅燦：我們很高興能在第二屆進(jìn)博會(huì)開(kāi)幕式上聽(tīng)到習(xí)近平主席的主旨演講，特別是關(guān)于中國(guó)市場(chǎng)的進(jìn)一步加大開(kāi)放、放寬市場(chǎng)準(zhǔn)入、改善營(yíng)商環(huán)境及加強(qiáng)知識(shí)產(chǎn)權(quán)保護(hù)等方面的信息，讓我們備受鼓舞。

我們十分感謝中國(guó)政府為建設(shè)良好營(yíng)商環(huán)境所做出的不懈努力，這也為樂(lè)高集團(tuán)將“寓教于樂(lè)”理念帶給更多中國(guó)孩子提供了契機(jī)。

Weappreciate Chinese authorities' efforts in providing a favourable business environment，as well as the opportunity to operate in China and bring Learning through Play to more children.

China is a strategic growth market for the LEGO Group， and President Xi's speech further strengthens our confidence in China and the future of our business in the country. We will continue to invest in China to bring creative LEGO play and high-quality learning through play experiences to many more Chinese children.

《法人》：中國(guó)政府非常重視對(duì)外商投資的保護(hù)?！吨腥A人民共和國(guó)外商投資法》也將于2020年1月1日起正式施行。您對(duì)這部新出臺(tái)的法規(guī)有哪些重點(diǎn)關(guān)注的內(nèi)容以及建議？

Faren Magazine:China attaches great importance to the protection of foreign investment. Foreign Investment Law of the People's Republic of China will come into effect since January 1st， 2020. As the General Counsel， what are your key focus on this law? And do you have any suggestions on it?

羅燦：作為一家外商投資企業(yè)，我們十分感謝中國(guó)政府為建設(shè)良好營(yíng)商環(huán)境以及知識(shí)產(chǎn)權(quán)保護(hù)方面所做的努力。在過(guò)去一年間，我們欣喜地見(jiàn)證了政府多個(gè)部門(mén)為我們不斷提供業(yè)務(wù)增長(zhǎng)契機(jī)，我們也特別感謝上海警方在“樂(lè)拼”一案中的公正執(zhí)法。上述種種舉措，都為在華外商投資企業(yè)營(yíng)造了可持續(xù)發(fā)展的理想營(yíng)商環(huán)境。

Robin Lynne Smith:Weappreciate the Chinese authorities' many efforts in creating a favourable business environment for foreign companies， and we are grateful for the continued focus on intellectual property protection and enforcement by them.

Over the past year， we have definitely seen increased efforts from many different government authorities to provide new opportunities for business growth， and we are certainly grateful for the efforts of Shanghai Police in the Lepin raid action. It is important for this work to continue in order to further develop a successful and sustainable business environment for all companies operating in China.
