GONG Ying

Fukuzawa Yukichi is the most representative enlightenment thinker in modern Japan. His thoughts, ways of thinking, educational ideas and practices have exerted a profound influence on the modernization process in Japan, and also some effects in China, the Korean Peninsula, causing some fundamental changes and social transformations in East Asia. His understanding of “humans” directly reflects the essential characteristics of his ideas. Man was not thought to be the product of God(Creator), ghosts being denied, reason trusted, and “heaven” as a regular existence valued. He emphasized that dignity distinguished human beings from animals. He was a firm believer in the doctrine of good human nature, believing that it was possible to overcome the evil of power by self-discipline. He advocated that all people are created equal and free, that people should share the freedom. Independence, self-respect and equality are not only his understanding of human beings, but also his expectation of human beings. Fukuzawa’s understanding of humans became the ideological foundation of his educational theory, which provided theoretical support for his establishment of schools, development of social education and shaping of a new ideal personality. His understanding of humans introduced new concepts such as natural & legal rights, freedom and equality, independence and self-respect, which expressed the growing demand for equality and triggered the overall reform in the Japanese society at that time.

The proposition that “Legal logic is an applied logic” leads to the question: What kind of applied logic is it? In other words, what more general logic does it “Apply” to? There is no doubt that this general logic has traditionally been assumed to be formal(deductive) logic. The most remarkable characteristic of legal argumentation is the orderly development of positive and negative arguments under legal confrontation system. From this point of view, the formal deductive logic cannot be the theoretical basis of the logic of legal argumentation. To solve the dilemma of traditional legal logic, it is necessary to take the change of logic view as the prerequisite, and to re-examine what kind of applied logic legal logic is. The concept, the route, the attribute question as the application logic, as well as the user friendly question, have constituted the important aspect of the new look of legal logic. Legal logic should take the rule of law as the background, take the legal argumentation as the starting point, center around the judicial ruling, take the legal argument scheme as the knot, integrate the various reasoning and arguments used in legal argumentation into a user-friendly system. A legal logic with such a look can help build the rule of law in China.

There is a complex identifying relationship between the characters in the story level, the narrator and narratee in the narrative level, the implied author and the implied reader in the narration level, and so the identifying mechanism in fictional rhetoric constitutes a complex dynamic system. Comprehensively examining the multiple inter-subjectivity of fictional rhetoric and thoroughly grasping the basic framework of the identifying mechanism in fictional rhetoric, we can construct an effective system to evaluate fiction. Through the identifying dimension, we can deeply understand the mental structure of the characters, narrators and implied authors, then inspect the degree of perfection in terms of the construction of the subject in fictional rhetoric; through the identifying direction, we can clearly recognize the different identifying methods led by external authority, internal authority and personal authority, then evaluate the degree of coordination in the rhetorical communication process; through the identifying strength, we can clearly measure the different intensities of the impact of the cognitive dimension, the appeal of the aesthetic dimension, and the assimilation of the ethical dimension, therefore grasp the effectiveness of the fictional rhetorical function. Wholly considering the dimension, direction and strength of the identifying mechanism in fictional rhetoric, will not only help to grasp the internal principle of fictional rhetoric more accurately so as to promote and deepen the fictional rhetoric theory on the macro level, but also to guide the close reading more practically so as to construct a new method of fiction criticism on the micro level.

The Civil Code regulations on public order and morals(POM) have constructed a principle system consisting of behavior orientation, application limitation, and effectiveness control, combined with life experience and judicial experience to carry out regular operations, which laid the foundation for principled judgments, built the framework of interpretation theory and established applicable bi-layer structure, responded to the uncertain dilemma of POM effectively. However, the fuzzy logic of the basic principle system, POM’s poor connection and the abstract expression determine the limits of Civil Code responses to the dilemma. Under the modern economic and social structure, when the civil law itself loses its self-sufficiency due to the dissolution of its own unified value system, the definition of POM must be sought from the constitution as the fundamental plan of modern society and the unified national order. Applicants of the law are free from the vague interpretation and subjective definition outside the constitution, which will only exacerbate the dilemma of uncertainty. Following the various connecting paths of the constitution and civil law, the application of POM should rely on the explanation of constitutionality, which can play its function as the basic principle of civil law validly.
